– Litigation involving the De Clercqstraat 113 Owners’ Association
The De Clercqstraat 113 Owners’ Association in Amsterdam West was approached by a new association member who wanted to change the designated use of his apartment into a hotel. This new member also owned the adjacent hotel and wanted to add the apartment to his hotel. The owners’ association did not consent to this. The hotel owner then requested alternative authorisation, arguing, among other things, that it would not be reasonable to allow one of the other owners to rent out his boxroom through AirBnB, if he was unable to use his apartment as a hotel. M2 Advocaten argued that the temporary letting of a boxroom through Airbnb cannot be equated with permanently operating an apartment as a hotel. The Court of Appeal agreed.

– Report by Omroep Flevoland on the conversion of office buildings in the centre of Almere
In 2013, the municipality of Almere worked on a new zoning plan for the city centre. Existing offices were simply designated as ‘offices’ again in the plan. A client of M2 Advocaten had several office buildings in the area covered by the plan. M2 Advocaten submitted an opinion on behalf of its client aimed at broadening the designated use to include a hotel or educational institution, for example, at that location. Unnecessary vacancy levels could be avoided in this way. The opinion was successful and the municipality of Almere broadened the designated use. Ginio Beij of M2 Advocaten was interviewed about this by the regional broadcaster Omroep Flevoland (lawyer: G.I. Beij).
